Acceptance of Terms

By accessing or using the Changelly platform at changelly.com, users agree to be legally bound by these Terms of Service in their entirety. These terms constitute a binding agreement between the user and the operating entity behind the service, governing all interactions with the platform including browsing, account creation, and transaction execution. If a user does not agree with any portion of these terms, they must discontinue use of the service immediately. Continued use of the platform following any published update to these terms constitutes acceptance of the revised version. The service reserves the right to require users to affirmatively re-confirm acceptance of material changes through in-platform prompts or email verification. Users are responsible for reviewing these terms periodically to remain informed of any modifications that may affect their rights or obligations.

Eligibility to Use Changelly

Access to Changelly is restricted to individuals who are at least 18 years of age and possess the legal capacity to enter into binding agreements under the laws of their jurisdiction. The service is not available to residents of countries subject to comprehensive international sanctions or to individuals appearing on government-maintained lists of prohibited persons. By using the platform, users represent and warrant that they meet all applicable eligibility requirements and that their use of the service does not violate any laws applicable to them. Businesses and corporate entities accessing the service on behalf of an organization represent that they are authorized to bind that organization to these terms. The platform reserves the right to request documentation verifying a user's eligibility and to suspend or terminate access if eligibility cannot be confirmed. Misrepresentation of eligibility is a material breach of these terms.

Account Terms and Registration

While basic swap functionality on Changelly can be accessed without a registered account, certain features — including higher transaction limits, order history tracking, and access to Changelly PRO — require account creation. Users who register an account must provide accurate, current, and complete information during the registration process and must keep that information updated throughout the life of the account. Each user may maintain only one account, and the creation of multiple accounts to circumvent limits or restrictions is prohibited. Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their account. Any unauthorized access or suspected security breach must be reported to the support team immediately. The service reserves the right to suspend or terminate accounts that display signs of fraudulent activity, policy violations, or prolonged inactivity.

Use of the Service

The exchange service provided by this platform is intended exclusively for lawful cryptocurrency swapping and related financial activities as described in the product documentation. Users agree to use the service only for its intended purposes and in compliance with all applicable laws and regulations in their jurisdiction. The platform grants users a limited, non-exclusive, non-transferable, and revocable license to access and use the service for personal or business swap transactions. This license does not permit users to resell the service, create derivative products based on the platform's technology, or use automated tools to extract data or manipulate transaction queues without written authorization. Intellectual Property Rights

Prohibited Conduct

Attempting to manipulate exchange rates, exploit system vulnerabilities, or interfere with the platform's technical infrastructure through denial-of-service attacks, injection attacks, or other means is expressly forbidden. Impersonating another user, platform employee, or third-party representative is prohibited, as is the submission of false identity documents during any verification process. The scraping of platform data, creation of bot-driven account networks, and use of the service to conduct market manipulation across connected exchanges are also violations of these terms. Any detected prohibited conduct may result in immediate account suspension, transaction reversal where possible, and referral to law enforcement.

Disclaimers and No Warranties

The Changelly platform and all services provided through it are offered on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. The service does not warrant that the platform will operate without interruption, that exchange rates will meet user expectations at any specific time, or that the platform will be free from errors, viruses, or other harmful components. No advice or information obtained from the service, whether oral or written, creates any warranty not expressly stated in these terms. Cryptocurrency markets are inherently volatile, and the service makes no representations about the future value of any digital asset exchanged through the platform. Users acknowledge that they assume all risks associated with cryptocurrency transactions, including the risk of market loss, smart contract vulnerabilities, and network congestion delays. The platform disclaims liability for outcomes arising from the inherent characteristics of blockchain technology.

Limitation of Liability

To the fullest extent permitted by applicable law, the liability of the platform and its affiliates, officers, employees, and agents for any claim arising out of or related to use of the service is limited to the total fees paid by the user for the specific transaction giving rise to the claim in the thirty days preceding the event. Under no circumstances will the service be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost cryptocurrency, or loss of data, even if the possibility of such damages has been communicated. This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, strict liability, or otherwise. Some jurisdictions do not allow the exclusion of certain damages, and in those jurisdictions the limitation will apply to the maximum extent permitted. Users who are dissatisfied with the service are advised that their sole and exclusive remedy is to discontinue use of the platform.

Indemnification

Users of this crypto exchange service agree to indemnify, defend, and hold harmless the platform, its parent company, affiliates, licensors, and each of their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses — including reasonable legal fees — arising out of or relating to the user's violation of these terms. This indemnification obligation covers claims arising from misuse of the service, submission of false information, violation of third-party rights, or any unlawful activity conducted through the platform. The service reserves the right to assume exclusive control of the defense of any matter subject to indemnification, in which case the user agrees to cooperate fully with the platform's defense efforts. Indemnification obligations survive the termination of a user's account or access to the service.

Dispute Resolution and Changelly Arbitration

Any dispute, controversy, or claim arising from or relating to the use of Changelly or these terms shall be resolved through binding individual arbitration rather than through class action litigation in court. Users agree to first attempt informal resolution by submitting a written notice of their dispute to the support team and allowing thirty days for good-faith negotiation before initiating formal proceedings. If informal resolution is unsuccessful, disputes will be submitted to a recognized arbitration body and resolved under its commercial arbitration rules. Arbitration proceedings will be conducted on an individual basis, and users waive any right to participate in class, collective, or representative actions. The arbitral award will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section prevents either party from seeking emergency injunctive relief from a court to prevent irreparable harm pending arbitration.

Termination of Access

The platform reserves the right to suspend or permanently terminate a user's access to the service at any time, with or without prior notice, for conduct that violates these terms, applicable law, or that the service determines in its sole discretion poses a risk to other users, the platform, or third parties. Users may also terminate their own accounts at any time by submitting a closure request through the support portal, subject to the completion of any pending transactions and satisfaction of any outstanding obligations. Upon termination, the user's license to access the platform ceases immediately, though provisions of these terms that by their nature survive termination — including intellectual property rights, disclaimers, liability limitations, and indemnification obligations — will remain in full effect. The service is not liable for any loss or damage resulting from the suspension or termination of access, including losses arising from inability to complete a transaction after access has been restricted.

Changes to These Terms

This crypto swap service reserves the right to modify these Terms of Service at any time to reflect changes in the law, evolving industry standards, or updates to the platform's features and business model. When material changes are made, the service will provide reasonable advance notice through the platform interface, by email to registered users, or through other appropriate communication channels. The effective date of the revised terms will be clearly indicated in the updated document. Users who continue to access or use the service after the effective date of any revision are deemed to have accepted the updated terms. Users who disagree with a change are entitled to terminate their account before the revised terms take effect. For significant modifications affecting user rights or financial terms, the service will make reasonable efforts to provide no less than fourteen days' advance notice prior to the effective date.
